CanAm Reinforces Its Commitment to EB-5 Program Integrity

USCIS has completed RIA-mandated audits of 11 CanAm-affiliated regional centers following reviews of its pre- and post-RIA EB-5 operations.

New York, NY | July 2026— The EB-5 Reform and Integrity Act of 2022 (“RIA”) directs U.S. Citizenship and Immigration Services (“USCIS”) to audit every approved regional center at least once every five years. These audits are a program-wide oversight measure intended to assess whether regional centers are complying with applicable EB-5 requirements in all material respects.

As part of this statutory audit cycle, CanAm Enterprises (“CanAm”) received three sets of audit requests from USCIS’s Immigrant Investor Program Office covering 11 CanAm-affiliated regional centers between September 2025 and May 2026. Because CanAm operates multiple USCIS-designated regional centers, these reviews were scheduled on a rolling basis across the statutory cycle.

As described in USCIS’s audit notifications, the audit process may include reviewing records required to be maintained by the regional center, the flow of investor capital into associated projects, USCIS filings, financial records, policies and procedures, and information obtained through document requests and interviews.

For each regional center, CanAm provided detailed and well-documented responses addressing both pre-RIA and post-RIA new commercial enterprises and EB-5 projects. The reviews covered, among other matters, regional center governance and operations, investor intake and onboarding, recordkeeping, fund administration, project monitoring, compliance filings, investor capital flows, redeployment activities, and third-party promoter relationships.

The audit process required close coordination among CanAm’s executive, legal, accounting, investor intake, project development, and asset management teams, together with representatives from JTC, CanAm’s third-party fund administrator.

CanAm also participated in three virtual audit sessions with members of the USCIS audit teams, each lasting between one and two days. During those sessions, CanAm representatives responded to questions and provided detailed explanations of CanAm’s policies, internal controls, operational processes, and oversight procedures.

CanAm appreciated the professionalism and preparedness of the USCIS audit teams throughout the process. Regional center audits perform an important program-integrity function established by the RIA, and CanAm believes that transparent, constructive engagement between USCIS and regional centers is essential to a strong and sustainable EB-5 Regional Center Program.

Each of the 11 audits has been formally concluded by USCIS, with no further action required at the time of closeout.
