Can you provide a brief overview of the EB-5 program and its significance for Indian investors?
The EB-5 program is an immigration-by-investment program created in the early ’90s. It allows investors to obtain conditional permanent residency in the United States. The program has gained stability, and there’s significant interest in it, particularly from Indian investors. Investors need to file an initial petition for conditional permanent residency, prove the lawful source of funds, and have the project’s status filed for their business plan to be reviewed by USCIS.

What are the pathways for EB-5 investors to obtain permanent residency?
EB-5 investors can either adjust their status if they are in the U.S. on another visa category or go to the consulate for an interview if they are outside the U.S. Once approved, they receive a conditional green card valid for two years. After 21 months, they can petition to remove the conditions by proving their investment created ten new U.S. jobs.

Are there specific sectors that are particularly appealing to Indian investors in the EB-5 program?

I believe it’s a wise consideration for those who can explore this option. While it might seem straightforward to switch from one visa category to another, the EB-5 route can be complex and comes with significant costs. However, when individuals have the means to do so, it’s worth considering because it offers the opportunity to minimize risk. The key is selecting the right project and company to invest in, which should ideally reduce any potential financial uncertainty.
