For most of 2026, the EB-5 conversation has centered on one date: the September 30 grandfathering deadline. For investors beginning the process now, that date is effectively out of reach. A complete Form I-526E filing depends on source-of-funds documentation, project selection, and subscription steps that rarely come together in a matter of weeks.

That timing reality does not close the window. A second date carries more practical weight for anyone starting now: January 1, 2027, when the EB-5 minimum investment amount is scheduled to rise for the first time since 2022. Acting before it takes effect secures the current amount, and the difference is measured in six figures.

What the September 30 Deadline Did

The grandfathering deadline protected a specific group. Investors who filed a Form I-526E petition on or before September 30, 2026 secured statutory protection against a future lapse of the Regional Center Program. Investors who file after that date forgo that particular protection. This is worth stating plainly, because the more useful question for a new investor is what still works in their favor. On that question, the answer is concrete.

The January 1, 2027 Increase, and Why It Rewards Acting Now

The current EB-5 minimums have held since the Reform and Integrity Act took effect in March 2022: $800,000 for projects in a targeted employment area or qualifying infrastructure project, and $1,050,000 for standard projects. These amounts remain in effect through the end of 2026.

Beginning January 1, 2027, the Act requires those minimums to adjust for inflation, using the Consumer Price Index for All Urban Consumers. The adjustment is automatic and written into the statute. It does not depend on new legislation, agency discretion, or any vote in Congress. That certainty is what makes it a firm planning date.

USCIS has not published the final figure, which depends on inflation data through the adjustment date. Independent analysts modeling the formula project a new TEA minimum in the range of roughly $900,000 and a standard minimum near $1.2 million. Those are projections, and the published amounts could land higher or lower. For an investor who completes a qualifying investment and files before the adjustment takes effect, the current amounts apply.

Two Deadlines, Two Different Risks

The September 30, 2026 grandfathering deadline and the January 1, 2027 increase are often discussed together, though they guard against different things. Grandfathering protects a filed petition from a future program lapse. The January increase raises the cost of entry for everyone who has not yet invested. One concerns legal protection; the other concerns price. For an investor starting now, the price date is the one within reach.

What Filing Without Grandfathering Means

An investor who files after September 30, 2026 does so without grandfathering protection. That protection matters because the Regional Center Program’s current authorization runs only through September 30, 2027, and Congress will need to act to extend it. The program has lapsed before, most recently between 2021 and 2022.

Industry practitioners broadly expect Congress to reauthorize the program, pointing to its bipartisan support, its economic contribution, and the integrity reforms the Reform and Integrity Act put in place. That expectation is well founded, though it remains an expectation. An investor filing without grandfathering should weigh it as part of the decision and consult immigration counsel on how a potential lapse could affect a pending petition.

What to Do Now

For investors drawn to EB-5, the timeline favors starting the groundwork promptly:

  • Begin assembling source-of-funds documentation, which is typically the longest part of the process.
  • Select a qualifying project and complete the investment and I-526E filing before the January 1, 2027 adjustment to secure the current investment amount.
  • Consult experienced immigration counsel on filing strategy and on how the 2027 reauthorization timeline bears on an individual case.

The September 30 deadline drew most of the attention this year, and for good reason. For investors starting now, though, the date that shapes the decision is January 1, 2027. The current investment amounts are a known quantity through the end of 2026, and acting within that window locks them in. The math rewards moving deliberately and soon.
